Product colours and finishes displayed are illustrative. Actual appearance may vary due to monitor calibration and manufacturing variation.

13. BACKORDERS (OUT OF STOCK)
tems not currently in stock may be placed on backorder. If a backordered item cannot be fulfilled within a reasonable period, GALE Pacific may cancel that portion of the order without liability.

14. RETURNS
Returns require prior written authorisation and must comply with GALE Pacific’s Commercial Return Policy. Unauthorised returns will be refused. Returned goods must be unused, in original packaging, and accompanied by the return authorisation number. Freight charges for returns are the customer’s responsibility unless otherwise agreed in writing.

15. PRICES AND AVAILABILITY
Prices and availability are subject to change without notice. Pricing errors may be corrected at any time, and GALE Pacific reserves the right to cancel orders reflecting incorrect pricing. Any overpayments resulting from cancellation will be credited promptly.

16. ORDER ACCEPTANCE
Quotation or acknowledgement of receipt does not signify acceptance. Orders are binding only upon written confirmation or shipment by GALE Pacific. GALE Pacific reserves the right to limit quantities or discontinue products without notice.

17. TAXES
All prices are exclusive of applicable sales, use, or excise taxes, which shall be added to the invoice as required by law. Customers are responsible for all such taxes, duties, or other charges imposed in connection with the sale or delivery of products.

18. REGISTRATION AND SECURITY
You agree to provide accurate, current, and complete registration information and to maintain the security of your account credentials. You are responsible for all activity that occurs under your account.

19. PAYMENT
For approved trade accounts, payment is due according to the terms stated on the invoice. Past-due balances may incur interest at the maximum rate permitted by law. GALE Pacific reserves the right to withhold shipments or suspend credit privileges for delinquent accounts. You are responsible for all costs of collection, including legal fees.

20. SECURITIES ISSUES
The parent of GALE Pacific is traded on the public stock exchange in Australia. This website and the information contained herein do not constitute an offer or solicitation for the purchase or sale of any securities.

21. RELATIONSHIP
Your use of this website does not create an employment, agency, partnership, or joint-venture relationship with GALE Pacific. Independent representatives accessing this website do so solely for business purposes consistent with their representative agreements.

22. GOVERNING LAW
This Agreement and its performance shall be governed by the laws of the State of Florida, United States of America, without regard to its conflict-of-laws provisions. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Florida for all disputes arising out of your use of this website and these Terms.

28. ENTIRE AGREEMENT
These Terms, together with any written agreements governing your account or purchases, constitute the entire agreement between you and GALE Pacific USA, Inc. regarding use of this website and supersede all prior understandings relating to the subject matter.

30. EXPORT AND COMPLIANCE
All products are sold in compliance with applicable U.S. export laws and regulations. You agree not to export, re-export, or distribute any products in violation of such laws. You are responsible for securing any required import or customs clearances at your expense.

31. SHIPPING & HANDLING
Unless otherwise agreed in writing, all sales are F.O.B. shipping point. Title and risk of loss pass to the customer upon delivery to the carrier. Freight charges are the responsibility of the customer and will be billed as specified on the invoice. Any claims for damage or loss in transit must be made directly with the carrier.
